TERMS AND CONDITIONS FOR HOTEL ACCOMMODATION & SERVICES

These Conditions are the standard terms and conditions that apply to the booking of any hotel room provided by Point Group Chios (hereinafter referred to as “the Company”) on behalf of the Estate, along with the provision of any services (hereinafter referred to as “the Services”) offered to and used by Guests. These Conditions set out your legal rights and responsibilities, our legal rights and responsibilities, and certain key information that we are required by law to provide to Consumers.

1. DEFINITIONS AND INTERPRETATION

1.1 Definitions

In these Conditions, the following expressions have the following meanings:

– Business: refers to any business, trade, craft, or profession carried on by you or any other person/organization.
– Conditions: means these terms and conditions as amended from time to time.
– Company/we/us/our: refers to Point Group Chios, the hotel owner.
– Consumer: means an individual customer or Guest who receives Services for personal use and for purposes wholly or mainly outside the purposes of any Business.
– Hotel: refers to Point Group Chios, its premises, and any other types of accommodation offered by the hotel.
– Late Cancellation Charge: means the charge applicable for late cancellations as specified in clause 4.4.
– Price List: means the hotel’s standard price list of Rates.
– Rates: means the prices payable for room accommodation and other Services provided by the Company.
– Regulations: means the relevant consumer protection regulations in force.
– Services: means the provision of accommodation in rooms at the Hotel and any other facilities, services, and items offered by the Company.
– Estate: refers to the Point Group Chios located in Chios.

1.2 Interpretation

In these Conditions:
1.2.1 A reference to a clause is a reference to a clause of these Conditions.
1.2.2 A reference to a ‘party’ refers to the parties to the Agreement and includes that party’s personal representatives, successors, and permitted assigns.
1.2.3 A reference to a ‘person’ includes a natural person, corporate or unincorporated body (whether or not having separate legal personality) and that person’s personal representatives, successors, and permitted assigns.
1.2.4 A reference to a ‘company’ includes any company, corporation, or other body corporate, wherever and however incorporated or established.
1.2.5 Words in the singular include the plural and vice versa.
1.2.6 Any words that follow ‘include,’ ‘includes,’ ‘including,’ ‘in particular,’ or any similar words and expressions shall be construed as illustrative only and shall not limit the sense of any word, phrase, term, definition, or description preceding those words.
1.2.7 A reference to ‘writing’ or ‘written’ includes any method of reproducing words in a legible and non-transitory form.
1.2.8 A reference to legislation is a reference to that legislation as amended, extended, re-enacted, or consolidated from time to time and includes all subordinate legislation made from time to time under that legislation.

2. RESERVATIONS

2.1 All reservations shall be governed by these Conditions. Guests may make a reservation for a room or other Services in advance through the Estate’s website, by telephone, or in person.

2.2 When making a reservation, Guests must provide their identification information, including but not limited to name, address, contact telephone number, and email address.

2.3 Payment details must be provided at the time of booking. The Company will take credit/debit card details, which must be valid beyond the date of the intended stay, and Guests authorize the use of this card for any due payments. Payment will be collected according to the terms indicated in clause 3 below.

2.4 A reservation request constitutes an offer to purchase the Services. The Company will confirm the booking and provide a booking reference, creating a binding contract between the Guest and the Company.

2.5 Guests may request changes to their reservation before arrival, subject to the cancellation provisions in clause 4 below. The Company will make reasonable efforts to accommodate these changes, but cannot guarantee availability.

2.6 Guests may make a booking upon arrival, subject to availability. If the requested room or Services are available, the Company will accept the booking.

2.7 Additional nights can be requested during the stay. The Company will make reasonable efforts to accommodate the request, and if accepted, it will form a binding contract between the Guest and the Company.

3. FEES AND PAYMENT

3.1 Rates, including any promotional Rates or special offers, will be made available on the hotel’s website, at the reception, or through other communication channels. All Rates shown in the Price List include VAT.

3.2 Rates apply to room accommodation and include all standard facilities provided by the hotel unless otherwise stated. Additional charges may apply for other Services, and the applicable Rates will be provided upon request.

3.3 Unless agreed otherwise, payment in full must be made at the time of check-out. The Company will provide an invoice for all sums due, and the Guest must settle the invoice in full.

3.4 Promotional Rates may require full payment at the time of booking. Additional charges incurred during the stay will be invoiced separately and must be paid as required.

3.5 The Company may alter Rates without prior notice, but any increase in Rate after booking will not apply to the existing reservation.

3.6 Payments for Services may be made by credit/debit card, cash, or bank transfer.

3.7 Full payment is required for any reservation, and refunds will only be made as specified in clause 4 or as required by consumer protection legislation.

4. CANCELLATIONS

4.1 Reservations may be canceled without charge if prior notice is given before the earliest check-in time as possible.
In such cases, the Company will provide a full refund of any advance payment.

4.2 Failure to provide prior notice of cancellation within the specified timeframes will result in a Late Cancellation Charge, as outlined in clause 4.4.

4.3 The Company may cancel a reservation in the following circumstances:
– Unavailability of accommodation, personnel, or resources necessary for the provision of the room, in which case the Guest will be offered alternative accommodation or a full refund.
– Non-arrival by stated time on the scheduled arrival date without prior notification, resulting in room reallocation and a Late Cancellation Charge.

4.4 A “Late Cancellation Charge” is a charge that accounts for the net financial loss incurred due to cancellation. The charge will be limited to the lesser of the full price of the booking or one night’s stay at the specified Rate. The Company may deduct the Late Cancellation Charge from any advance payment made by the Guest.

5. CHECK-IN AND CHECK-OUT

5.1 The earliest check-in time is stated in each location.

5.2 Guests may be required to provide proof of identity upon check-in, such as a passport or driving license.

5.3 The latest check-out time stated in each location.

5.4 Late check-out may be arranged with the Company, subject to availability. An hourly rate will apply for the additional time beyond the standard check-out time.

6. HOTEL RULES

6.1 Guests must conduct themselves in a reasonable and responsible manner on hotel property, avoiding any disturbance to other guests. Failure to comply may result in removal from the hotel and payment of all outstanding sums.

6.2 Smoking, including e-cigarettes, is strictly prohibited anywhere on the premises. A charge may apply for cleaning and restoring rooms to a smoke-free environment if this rule is violated.

6.3 Unless agreed in advance for pet-friendly rooms, guests should not bring animals or pets onto the hotel premises, with the exception of assistance or guide dogs.

6.4 Guests must not bring hazardous materials, tamper with fire alarms or emergency equipment, store items that may cause damage or pose a risk to health and safety, remove or damage hotel property, download unlawful or obscene material using hotel technology, or cause unreasonable disturbance to other guests or staff.

6.5 Guests under 16 years of age must be accompanied by an adult aged 18 or older.

6.6 Guests will be responsible for any damage caused to hotel property during their stay.

6.7 The above rules apply to the guests’ party and any guests they invite, and the Guest will be liable for any breaches.

6.8 In case of damage or loss caused by the Guest or their group, the Guest making the booking will be held responsible and required to reimburse the costs incurred.

6.9 The Company reserves the right to take necessary actions in response to breaches of these rules, including canceling the reservation, restricting access to the hotel, removing items from the room, retaining payment, refusing future reservations, or refusing entry/accommodation.

6.10 The Company will not be liable for any refunds or compensation in such circumstances.

6.11 The Company reserves the right to decline or cancel reservations made by individuals who have previously breached these Conditions.

7. OCCUPANCY

7.1 The maximum occupancy is stated in each location. Guests must not exceed the maximum occupancy allocated to their room.

7.2 Children under 16 may only stay if accompanied by a parent or guardian staying at the hotel.

7.3 The Company reserves the right to change room allocation during the stay if necessary.

8. FOOD AND DRINK

8.1 Rates for room accommodation do not include food and drinks unless otherwise stated. Additional charges will apply for these services.

8.2 Guests with special dietary requirements should notify the hotel in advance, and the Company will make reasonable efforts to accommodate them.

9. CAR PARKING

9.1 Car parking spaces cannot be guaranteed, but guests may use available spaces on a first-come, first-served basis. Vehicle registration number must be provided upon arrival.

9.2 Disabled parking spaces cannot be guaranteed.

9.3 The Company does not guarantee protection against theft or damage caused by third parties. Guests accept the risk and responsibility for their vehicles and property.

10. LIMITATION OF LIABILITY

10.1 The Company will be responsible for foreseeable loss or damage resulting from breach of these Conditions or negligence. The Company will not be responsible for unforeseeable loss or damage.

10.2 Nothing in these Conditions excludes or limits the Company’s liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

10.3 The Company will not be liable for any indirect or consequential loss or damage, loss of profit, loss of business, loss of revenue, loss of anticipated savings, or any other indirect or consequential loss.

11. DATA PROTECTION

11.1 The Company will process personal data in accordance with applicable data protection laws and regulations. For further information, please refer to the hotel’s Privacy Policy.

12. GENERAL

12.1 The Company may assign, subcontract, or transfer any of its rights or obligations under these Conditions to any third party at its discretion.

12.2 These Conditions and any documents referred to in them constitute the entire agreement and understanding between the Guest and the Company. Any previous agreements, arrangements, or understandings between the parties regarding the Services are superseded.

12.3 If any provision of these Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

12.4 No failure or delay by the Company to exercise any right or remedy provided under these Conditions or by law shall constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict the further exercise of that or any other right or remedy.

12.5 These Conditions and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the jurisdiction in which the Hotel is located. The courts of that jurisdiction shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Conditions.

By making a reservation and accepting these Conditions, the Guest confirms that they have read, understood, and agree to be bound by these Conditions.

13. REGULATIONS

13.1 The Company is required by applicable consumer protection regulations to provide certain information to Consumers before making a contract. This information is included in these Conditions and will be considered part of the contract between the Guest and the Company.

14. COMPLAINTS

14.1 The Company welcomes feedback from Guests and aims to ensure a positive experience. If the Guest has any cause for complaint regarding the Services or any other aspect of their stay, they should raise the matter with the relevant General Manager at the Hotel. Contact details can be found on the Hotel’s website or provided upon request.

15. FORCE MAJEURE

15.1 The Company shall not be in breach of these Conditions or liable for any delay or failure to perform its obligations under these Conditions if such delay or failure is caused by events, circumstances, or causes beyond its reasonable control. This includes, but is not limited to, power failure, internet service provider failure, fire, flood, storms, earthquakes, acts of terror, or any other events beyond the Company’s control.

16. NO WAIVER

16.1 If the Company does not enforce any of its rights or remedies under these Conditions, it does not mean that it has waived those rights or remedies. Any waiver must be in writing and will not automatically waive any future default by the Guest.

17. SEVERANCE

17.1 If any provision of these Conditions is deemed unlawful, invalid, or unenforceable, the remaining provisions shall remain in full force and effect. The unlawful, invalid, or unenforceable provision shall be severed from these Conditions.

18. GOVERNING LAW AND JURISDICTION

18.1 These Conditions, any contract between the Guest and the Company, and the relationship between the parties (whether contractual or otherwise) shall be governed by and construed in accordance with the laws of the jurisdiction in which the Hotel is located.

18.2 Any dispute or claim arising out of or in connection with these Conditions (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.

19. UPDATES TO THESE CONDITIONS

19.1 The Company may make changes to these Conditions from time to time without prior notice. The updated Conditions will be effective upon posting on the Hotel’s website or other communication means.

20. HOW WE USE YOUR PERSONAL INFORMATION

20.1 The Company will collect, process, and use personal information provided by the Guest in accordance with its privacy policy. The privacy policy explains what personal information is collected, how and why it is collected, stored, used, and shared, the Guest’s rights in relation to their personal information, and how to contact the Company or supervisory authorities with any queries or complaints. A copy of the privacy policy can be found on the Hotel’s website or obtained upon request.

By accepting these Terms and Conditions, the Guest acknowledges that they have read, understood, and agree to be bound by all the provisions outlined herein.
